一、定义及协议范围

定义

协议范围

本协议是您与开若图公司之间关于您下载、安装、使用 dooo0t 产品所订立的协议，包括本协议正文、《dooo0t 隐私政策》及开若图公司已经发布或将来可能发布并以合理途径通知的各类规则、规范、通知等。所有规则均为本协议不可分割的组成部分，与本协议具有同等法律效力。

二、服务内容与说明

核心功能

dooo0t 为您提供图片波点拼接处理服务，核心流程为：上传图片→调节参数→导出生成图。

服务获取

您可通过我们授权的应用市场下载并安装 dooo0t 客户端，或通过 dooo0t 网页版体验服务。如您并非从上述正规途径获取 dooo0t 产品，我们无法保证该版本为官方版本，亦不对因此导致的任何损失承担责任。

服务授权

我们授予您一项个人的、不可转让的、非独占的、有限的合法使用 dooo0t 的权利，仅限于您的个人非商业目的使用。本协议未明示授权的其他一切权利均由开若图公司保留。

用户行为规范

您在使用 dooo0t 时，不得上传、处理或导出以下内容：

  1. 反对宪法确定的基本原则的；
  2. 危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的；
  3. 损害国家荣誉和利益的；
  4. 歪曲、丑化、亵渎、否定英雄烈士事迹和精神，侵害英雄烈士姓名、肖像、名誉、荣誉的；
  5. 宣扬恐怖主义、极端主义或煽动实施恐怖活动、极端主义活动的；
  6. 宣扬民族仇恨、民族歧视，破坏民族团结的；
  7. 破坏国家宗教政策，宣扬邪教和封建迷信的；
  8. 散布谣言、虚假信息，扰乱经济秩序和社会秩序的；
  9. 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；
  10. 侮辱或诽谤他人，侵害他人名誉权、隐私权、肖像权或其他合法权益的；
  11. 侵害他人知识产权的内容，包括但不限于未经授权使用他人享有著作权的图片；
  12. 法律、行政法规禁止的其他内容。

三、权利与许可

知识产权归属

dooo0t 本身自带的所有版本、技术、程序、素材及信息内容（包括但不限于产品功能、人机界面、操作流程、商标、专利、计算机软件作品等）的知识产权均归开若图公司或其许可方所有。开若图公司向您提供的软件使用许可，在任何情况下均不应视为向您转让或共享其知识产权的部分或全部。

用户图片权利

您上传的用户原始图片的著作权及其他知识产权仍由您或相应权利人享有，开若图公司不因提供本地处理服务而主张对用户原始图片的任何权利。

禁止行为

除非法律允许或经开若图公司书面许可，您不得：

  1. 对 dooo0t 产品进行反向工程、反向汇编或尝试获取源代码；
  2. 利用机器人、爬虫等程序抓取、复制或镜像产品内容或数据；
  3. 使用未经授权的第三方软件、外挂干扰、破坏产品正常运行；
  4. 实施危害网络安全的行为，包括非法侵入、干扰功能或传播恶意程序。

四、未成年人保护

年龄要求

若您未满 18 周岁，请在监护人的陪同下阅读并同意本协议，并在取得监护人同意后方可使用 dooo0t。若未成年人未经监护人同意擅自使用，开若图公司有权在知悉后采取限制措施。

监护人责任

若您是未满 18 周岁的未成年人，您应在监护人的监护与指导下使用 dooo0t。作为监护人，请您密切关注被监护人的使用情况，引导其合理使用，并确保其上传的图片内容符合本协议规定。

五、免责声明与责任限制

服务"现状"提供

开若图公司按"现状"提供 dooo0t 服务，在适用法律允许的最大范围内，不对服务的持续可用性、无错误性或对特定目的的适用性作出任何明示或默示保证。

输出效果说明

dooo0t 产品的图片处理效果依赖用户上传图片的质量、分辨率、色彩等因素，最终生成效果可能因图片本身条件的不同而存在差异，开若图公司不对生成图的特定视觉效果作出保证。

第三方内容责任

您上传的用户图片内容由您自行负责。因您上传的图片内容侵犯他人权利（包括但不限于肖像权、著作权、隐私权）而产生的一切责任，由您自行承担，开若图公司不承担因此产生的任何法律责任。

责任限制

在适用法律允许的最大范围内，因使用或无法使用 dooo0t 产品所造成的任何直接、间接、附带、特殊或后果性损失（包括但不限于利润损失、数据丢失），开若图公司均不承担赔偿责任。

不可抗力

因不可抗力（包括但不限于自然灾害、政府行为、网络故障等）导致服务中断或终止，开若图公司不承担违约责任，但将尽合理努力减少因此对您造成的影响。

六、服务变更与终止

开若图公司持续改进 dooo0t 产品，可能不定期对产品功能进行更新、调整或终止。您应将软件更新至最新版本，否则开若图公司不保证旧版本的全部功能可正常使用。

您理解并同意，开若图公司根据自身商业决策、政府行为或不可抗力等原因，可能选择中止、中断或终止 dooo0t 产品的部分或全部服务。

七、协议变更

为给您提供更好的服务，或因国家法律法规、政策调整、技术条件、产品功能等变化的需要，开若图公司会适时对本协议进行修订，修订内容构成本协议的组成部分。若您继续使用 dooo0t 产品，即视为您同意接受修订后的协议内容。若您不同意修订后的协议，请立即停止使用 dooo0t 产品。

八、法律适用与争议解决

本协议的订立、生效、履行、解释、修订、终止及纠纷解决，适用中华人民共和国法律法规（仅为本协议之目的，不包括香港特别行政区、澳门特别行政区法律，以及中国台湾地区有关规定）。

若您与开若图公司之间发生任何纠纷或争议，双方应首先友好协商解决。协商不成的，您同意将纠纷或争议提交开若图公司住所地人民法院管辖。

九、其他

本协议条款无论因何种原因部分无效或不可执行，其余条款仍有效，并对双方具有约束力。

开若图公司对本协议享有最终解释权。

Important Notice
Welcome to the dooo0t products and services provided by Kairuotu Technology (Shanghai) Co., Ltd. (hereinafter referred to as "Kairuotu" or "we"). Before you begin using dooo0t, please read and fully understand this Agreement carefully.

Kairuotu hereby draws your attention to the clauses regarding exemption or limitation of liability (highlighted in bold) as well as the clauses on applicable law and dispute resolution. Please read all clauses carefully and ensure you fully understand them before proceeding.

If you are under 18 years of age, please read this Agreement accompanied by your legal guardian (hereinafter referred to as "Guardian") and use dooo0t only after obtaining your Guardian's consent.

By clicking "Agree" or by actually using the dooo0t product, you are deemed to have read and accepted the entire content of this Agreement. If you do not agree to this Agreement or any of its terms, please immediately cease using the dooo0t product.

I. Definitions and Scope of Agreement

Definitions

Scope of Agreement

This Agreement is entered into between you and Kairuotu regarding your download, installation, and use of the dooo0t product. It incorporates the main text of this Agreement, the dooo0t Privacy Policy, and all rules, specifications, and notices that Kairuotu has published or may publish in the future through appropriate channels. All such rules form an integral part of this Agreement and have the same legal effect.

II. Service Description

Core Functionality

dooo0t provides an image halftone dot-mosaic processing service. The core workflow is: upload image → adjust parameters → export generated image.

Obtaining the Service

You may download and install the dooo0t client from our authorized app marketplaces, or experience the service through the dooo0t web version. If you obtain dooo0t from any source other than these authorized channels, we cannot guarantee that such a version is an official release, and we accept no liability for any losses arising therefrom.

License Grant

We grant you a personal, non-transferable, non-exclusive, limited license to use dooo0t lawfully, solely for your personal, non-commercial purposes. All rights not expressly granted under this Agreement are reserved by Kairuotu.

User Conduct

When using dooo0t, you must not upload, process, or export content that:

  1. Opposes the basic principles established by the Constitution;
  2. Endangers national security, divulges state secrets, subverts state power, or undermines national unity;
  3. Damages national honor or interests;
  4. Distorts, defames, desecrates, or denies the deeds and spirit of heroes and martyrs, or infringes upon their names, likenesses, reputations, or honors;
  5. Advocates terrorism or extremism, or incites terrorist or extremist activities;
  6. Promotes ethnic hatred or ethnic discrimination, or undermines ethnic unity;
  7. Undermines the state's religious policies, or promotes cults or feudal superstitions;
  8. Spreads rumors or false information, disrupting economic or social order;
  9. Disseminates obscene, pornographic, gambling, violent, murderous, or terrorizing content, or content that instigates criminal activity;
  10. Insults or defames others, or infringes upon others' right of reputation, right of privacy, right of likeness, or other lawful rights and interests;
  11. Infringes upon others' intellectual property rights, including but not limited to unauthorized use of images in which others hold copyright;
  12. Any other content prohibited by laws or administrative regulations.

III. Rights and Licenses

Intellectual Property Ownership

All intellectual property rights in all versions, technologies, programs, materials, and informational content inherent to dooo0t (including but not limited to product features, user interfaces, operational processes, trademarks, patents, and computer software works) belong to Kairuotu or its licensors. The software license granted by Kairuotu to you shall not, under any circumstances, be construed as a transfer or sharing of any part or all of its intellectual property rights.

User Image Rights

Copyright and other intellectual property rights in the original images you upload remain vested in you or the respective right holders. Kairuotu does not assert any rights over your original images by virtue of providing local processing services.

Prohibited Actions

Unless permitted by law or authorized in writing by Kairuotu, you must not:

  1. Reverse-engineer, decompile, or attempt to extract the source code of the dooo0t product;
  2. Use bots, crawlers, or similar programs to scrape, copy, or mirror product content or data;
  3. Use unauthorized third-party software or plug-ins to interfere with or disrupt the normal operation of the product;
  4. Engage in any conduct that compromises network security, including unauthorized intrusion, functional interference, or the distribution of malicious programs.

IV. Protection of Minors

Age Requirement

If you are under 18 years of age, please read and agree to this Agreement accompanied by your Guardian, and use dooo0t only after obtaining your Guardian's consent. If a minor uses dooo0t without the Guardian's consent, Kairuotu reserves the right to impose restrictions upon becoming aware of such use.

Guardian Responsibility

If you are a minor under the age of 18, you should use dooo0t under the supervision and guidance of your Guardian. As a Guardian, please closely monitor the minor's use of the service, guide them toward responsible usage, and ensure that any images uploaded by the minor comply with the requirements of this Agreement.

V. Disclaimers and Limitation of Liability

Service Provided "As Is"

Kairuotu provides the dooo0t service on an "as is" basis. To the maximum extent permitted by applicable law, Kairuotu makes no express or implied warranties regarding the continued availability, error-free operation, or fitness for a particular purpose of the service.

Output Quality

The image processing results of dooo0t depend on factors such as the quality, resolution, and color characteristics of the images you upload. The final output may vary based on the inherent properties of the uploaded image. Kairuotu does not guarantee any specific visual outcome of the Generated Images.

User-Uploaded Content

You are solely responsible for the content of the images you upload. All liability arising from your uploaded images infringing upon the rights of others (including but not limited to right of likeness, copyright, and right of privacy) shall be borne by you alone. Kairuotu shall bear no legal liability in connection therewith.

Limitation of Liability

To the maximum extent permitted by applicable law, Kairuotu shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to loss of profits or loss of data) arising from the use of, or inability to use, the dooo0t product.

Force Majeure

Kairuotu shall not be held liable for breach of contract in the event of service interruption or termination caused by force majeure events (including but not limited to natural disasters, governmental actions, or network failures), but will make reasonable efforts to minimize the impact on you.

VI. Service Changes and Termination

Kairuotu continuously improves dooo0t and may periodically update, modify, or discontinue product features. You should keep the software updated to the latest version; otherwise, Kairuotu does not guarantee the full functionality of older versions.

You understand and agree that Kairuotu may, at its discretion, suspend, interrupt, or terminate part or all of the dooo0t services based on its own business decisions, governmental actions, or force majeure events.

VII. Amendments to the Agreement

In order to provide better services, or in response to changes in laws and regulations, policies, technical conditions, or product features, Kairuotu may revise this Agreement from time to time. Such revisions shall form part of this Agreement. Your continued use of the dooo0t product following any revision shall be deemed your acceptance of the revised Agreement. If you do not agree to the revised Agreement, please immediately cease using the dooo0t product.

VIII. Governing Law and Dispute Resolution

The formation, validity, performance, interpretation, amendment, termination, and dispute resolution of this Agreement shall be governed by the laws and regulations of the People's Republic of China (solely for the purposes of this Agreement, excluding the laws of the Hong Kong Special Administrative Region, the Macao Special Administrative Region, and the relevant provisions of the Taiwan region).

In the event of any dispute or controversy between you and Kairuotu, the parties shall first attempt to resolve the matter through friendly negotiation. If negotiation fails, you agree to submit the dispute to the people's court with jurisdiction over the place where Kairuotu is domiciled.

IX. Miscellaneous

If any provision of this Agreement is or becomes invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding upon both parties.

Kairuotu reserves the right of final interpretation of this Agreement.
